Detailed Description of Goods and/or Services


Art of Print is a business in the photographic industry that markets fine art printing and framing.
Art of print has a physical store in Pretoria and makes use of couriers to deliver nationwide.


Scope:These general conditions of sale (hereinafter referred to as the "general conditions") govern the contractual relationship between any user of the artofprint.co.za site (hereinafter referred to as "user" or "you") and the company.

These general conditions of sale are the only ones applicable and replace all other conditions, unless a derogation has been granted expressly and in writing. Art of Print may from time to time modify some of the provisions of its general terms and conditions. It is therefore necessary that you read them each time you visit the artofprint.co.za site (hereinafter referred to as "the site"). These modifications are enforceable from the time they are posted online (the date of posting appears at the end of these conditions) and cannot be applied to contracts concluded previously.

Each purchase made on the site is governed by the general conditions applicable on the date of the order. Validating your order implies acceptance of the general terms.

Art of Print provides services, performance and deliveries exclusively on the basis of these General Terms and Conditions.

Art of Print does not recognize any deviating conditions unless Art of Print has explicitly acknowledged their validity in writing.


Use of the site: 


The use of the site is conditioned by the acceptance of the general conditions of sale and, if necessary, by the respect of the applicable conditions of use. You guarantee the truthfulness and accuracy of the information provided by yourself on the site.

The user agrees not to upload any content on the site that may infringe the law in force. This includes criminal law, copyright, trademark law and other property rights or rights of third parties.

Art of Print strives to guarantee the accuracy of the information presented on the site as well as its updating. The company also reserves the right to modify its content at any time and without notice. However, Art of Print cannot guarantee the accuracy, precision and completeness of the information made available on the site. Consequently, Art of Print cannot be held responsible in the event of unavailability of the site, bug or failure, as well as direct or indirect damage resulting from the fraudulent intrusion of a third party, whatever the nature of this damage, its causes and consequences.

Similarly, Art of Print cannot be held liable if use of the site (as a whole or not) proves impossible, and/or in the event of malfunction of the site or the system on which it is based. Art of Print cannot be held responsible for malfunctions attributable to software, whether integrated into the site or supplied with it.


This section concerns our services with regard to printing, framing and lamination of works carried out by us at your request.


1. What services do we provide?


Art of Print produces framed prints and prints as well as professional quality DiaMounts, from your photographs/artwork.



2. Workflow, production clearance, termination


2.1. A contract of sale shall not be concluded until we send the ordered product to you. The delivery fee must be invoiced. This will be indicated on the order. Should any taxes or excise duties be incurred in case of delivery to a country outside of South Africa, all such costs shall be borne by you.

2.2. All delivery deadlines indicated by us are non-binding.




3. What remuneration do we receive for our services?


The remuneration for our services is calculated with respect to the current price list available for viewing at artofprint.co.za as specified within the order process. We shall at all times be entitled to change the price list for future orders without prior notification.


4. How does billing work?


4.1. Payment may be made via Visa, Master Card and Maestro cards or by bank transfer into the Outdoorphoto bank account, the details of which will be provided on request. Payflex is provided as an option for specific items and to a value not exceeding R40,000. If you choose to collect in-store, you're welcome to pay on collection.

* We regret that no American Express or Diner's Club cards can be accepted.

4.2. Whatever the method of payment chosen by the user, in order to guarantee the security of online payments and the protection of your personal data, the data relating to the transaction are encrypted using SSL (Secure Socket Layer) technology, which makes it possible to secure their transmission. They are in no way communicated to Art of Print and do not circulate unencrypted on the internet. They cannot be intercepted.

4.3. The data recorded by the site constitutes proof of all transactions between Art of Print and its customers.



5. Retention of title


Art of Print retains full ownership of the products sold until payment of the amount of the order has been made in full.


6. Receipt of order


6.1 In the event of a complaint, all supporting documents relating to the order must be sent to us within a maximum period of 10 working days. For the calculation of this period, the delivery date as well as the day of receipt of the complaint will be taken into account. If these documents are not made available to us, the examination and immediate processing of the complaint will not be guaranteed.

If you are a reseller, you must check the condition of the products immediately after their delivery as part of routine business. You must also send us your complaint in writing without delay.

6.2 In case of defect, we shall be entitled, at our option and within a reasonable period, to make a new delivery or to repair the defect. Should the attempt to deliver a replacement or to repair the defect be unsuccessful, you shall be entitled at your option either to rescind the contract or to demand an appropriate reduction in price.

6.3. The papers, dyes, chemicals and other materials used in our materials and manufacturing processes may, like other dyes, show trivial changes over time. These changes may be different from one production batch to another. Such discrepancies in product characteristics shall not form a sufficient basis for defect.


7. Placing an order


To place an order, you must go through the following steps:

  • 1. Click "Create now" on the product you would like to order.

  • 2. Upload your file and follow the prompts.

  • 3. Finally, click "add to cart": after your confirmation, the order is added to your basket

Validating your basket is equivalent to accepting these general conditions of sale. You can consult the general conditions at any time on the site.

Once the order has been placed, Art of Print sends you a confirmation email. Under certain circumstances, Art of Print reserves the right to reject a customer's order. Art of Print may use this right in particular when payment for a previous order has not been made. This is because the solvency of a customer is not assured.

The contract is concluded when written confirmation of the order is sent by Art of Print, or when Art of Print begins its execution. The amount of the order is due immediately unless you choose to pay in-store.


 Note: 


You may not use any of the following materials in the design of your product:

  • Any unlicensed copyrighted materials from photographers, artists, publishers, composers, writers, or any other authors of original works. The copyright owner’s exclusive rights prohibit the reproduction of any original work without their consent. You are responsible for all possible consequences of unlawful use of protected data.

  • Any material that is unlawful, indecent, pornographic, obscene, lewd, filthy or vile or is inappropriate and harmful to children in any way

  • Any material that is a threat to injure the personal property or reputation of another person, a threat to accuse any person of a crime, a threat to inform another that a person has violated any law of South Africa, or a threat of blackmail.

  • Any material promoting racism or hatred against an individual or group. As well as any defamatory remarks directed at any other person or company.

  • Any material that contains viruses, worms, Trojan horse or any other corrupted codes or files. Art of Print is not responsible for checking the content of orders submitted. 

You acknowledge and agree that you will be liable for any action taken against Art of Print in relation to any such activities. You will fully indemnify Art of Print against any such claims, actions, demands or costs that may arise as a result. You further acknowledge and agree that Art of Print may preserve content and may also disclose content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to:

  • Comply with legal process;

  • Enforce the terms of service;

  • Respond to claims that the content violates the rights of third-parties; or

  • Protect the rights, property, or personal safety of Art of Print, its users and the public.


8. Shipping fees


Art of Print charges shipping for orders made with the "home delivery" delivery method. These costs are listed and are indicated in the shopping cart.

Delivery is free for orders made with the "Click & Collect" delivery method.

The customer has a period of 4 months after being notified of the availability of his order to collect it. Failing this, the order will be cancelled. As compensation, the supplier retains the sums paid previously. After this point, the customer is not entitled to a refund or discount.

In the event of shipment to countries outside of South Africa, the customer, as importer, is responsible for the payment of taxes/customs fees and for the payment of VAT.


9. Duty to safeguard information


Before communication of your mandate to us, it shall be incumbent upon you to make a backup copy of all sent data contents. Should you fail to make such security backups and damage or loss is incurred within the scope of this mandate, we shall not be liable for any damage which could otherwise have been avoided, had a security backup copy been kept.


10. Protection of personal data


The personal information that you entrust to Art of Print is stored on the secure servers of our host Open Resources (excluding bank data). Our access to this information is restricted to functions related to registration, processing orders, statistical operations to improve our services, and sending newsletters, among others.

Our use of your personal information (title, surname and first name, postal address, e-mail address, and telephone number, as well as payment information) is solely intended to process and fulfill your order, including sending you e-mail notifications to inform you about the status of your order. We also save the terms of the contract and send you order information by e-mail. When you subscribe to the newsletter, your e-mail address is also used for advertising purposes until you decide to unsubscribe. We would like to remind you that you can revoke your consent to the use of your e-mail address by Art of Print for advertising purposes at any time with effect for the future.

In the "my customer account" section protected by a password, the personal data that you provide, modify, or delete is used exclusively to fulfill the contract. Some of your personal data (title, surname and first name, contact details, telephone number) are made available to our logistics department for the shipment of your order. No other transmission of your data is carried out, unless it is made necessary by a legal or regulatory obligation. The same principle applies to the personal data that you have communicated to us when contacting us.

In order to guarantee you absolute security, we only communicate payment data (such as your bank details or credit card information) to our payment service provider, and we do not keep them ourselves. This data will be requested again with each order.

The data relating to the images that you have uploaded to the site are in no way used by Art of Print for advertising purposes or for any other purpose without your explicit authorization. In addition, Art of Print undertakes not to transmit your photographs to third parties, and to destroy the files within 12 months following the placing of the order.


11. Intellectual property


The user certifies that they hold all the necessary intellectual property rights associated with the images ordered on the site.

As such, Art of Print cannot be held responsible in the event of copying, counterfeiting, imitation, and more generally in the event of reproduction or partial or complete use of the images used by the user.

12. Courier Services and Liability for Artwork Damages


Please note that if clients opt to package and arrange courier services for their framed artwork and prints themselves, our liability for any damages incurred during transit is void. While we take every precaution to ensure that all items are carefully packaged and in pristine condition before leaving our premises, we cannot assume responsibility for damages that may occur once the items are entrusted to an externally arranged courier. It is advisable for clients to thoroughly inspect their items upon collection and to address any concerns regarding transportation directly with their chosen courier service provider.


13. Turn around time


  • Canvas: 3-5 working days
  • Printing: 2-3 working days
  • Framing: 5-7 working days
  • DiaMounts: 14 working days

We're closed on Sundays, Public Holidays, Easter Weekend, and Between Christmas and New Year.
